喬寶寶點解要被迫移民?

喺香港出世,曾經喺香港政府做公務員嘅印度裔香港人喬寶寶,因為要陪老婆坐移民監被迫離開香港,放棄得嚟不易嘅事業。

呢單嘢係一單徹頭徹尾大中國沙文主義國籍法搞出嘅硬膠,而呢單嘢,我喺7月12日嘅《新報》專欄解釋,我亦喺呢度解釋吓。

喬寶寶同佢嘅子女,肯定係英國公民。喬寶寶嘅英國公民身份來源同小弟一樣,因為中國唔認為喬寶寶有中國血統(但中國血統呢個關鍵法律用詞未有定義過,特別中國有五十六個民族,最攞命係《中國國籍法》根本唔係用血統主義),所以喺香港出世嘅喬寶寶由British Nationality (Hong Kong) Act 1997因為只有BN(O)/BDTC,而可以登記成為British Citizen,佢子女都係British Citizen。

但喬寶寶老婆係印度公民,她住咗喺香港廿二年唔批特區護照,除咗可能係歸化中國國籍失敗外,更有可能係連香港永久居民身份都批唔到(成日穿梭英港兩地咪港府有啲硬膠理由唔批永久居民),而英國Border Agency一向都歧視印度公民,喬寶寶佢有米都好,如果喬太無辧法搵到嘢做,有任何risk要令喬太生活用到public fund,例如分隔兩地太耐會離婚,都會導致喬太英國簽證批唔出。咁喬寶寶面對香港同英國都歧視佢嘅困境,唯有佢明明係British Citizen都坐移民監,直至佢老婆歸化成British Citizen為止,或者至少喺英國無限制居留為止。

點解我喺facebook一開始追殺曾志豪同梁啟智,因為雙非同香港零關係,你班大中國種族主義膠就要包容,咁喬寶寶呢,佢係香港人,香港土生土長甚至連TVB我地都睇佢做戲呀。梁啟智後嚟被人追殺到要出聲撐喬寶寶,但曾志豪呢條友至今未出過聲,我想知佢想點。(咁又係嘅,梁生乜好想我再追殺佢多一鑊汪精衛)

1995年,我有份喺《南華早報》來函要求英國政府先俾少數族裔英國公民,最初唔係為平權,而係中國人對少數族裔果種排擠係好得人驚。而少數族裔定居英國係唔叫好選擇,因為佢地生活圈子全部喺香港,去英國唔知做乜,但返印度又唔得,因為呢班人唔少係種姓制度嘅受害者,或喺印度無晒親友,都唔知點開始過。香港係佢地嘅家,但中國政府喺《基本法》亂咁寫國籍同居留權定義,令佢地全無保障。

我認為最文明嘅做法,係香港三百五十萬BN(O)及後代可以作出類似1955年中國印尼雙重國籍協定嘅國籍選擇,印巴裔人可以選擇成為中國公民,而因政治或宗教緣故明知不見容於中共嘅華裔人士(乜叫華裔,其實好難定義),可以選擇成為英國公民,唔要中國公民身份,而永久居民定義上,就不論國籍一視同仁。

只不過以大中國膠嘅沙文主義,以及中共一貫有佢講無人講嘅法律觀,佢地會做文明嘅事就奇。

後話:所以有言在先,一旦香港獨立,我實爭取兩點:
a. 所以莊豐源案後取得香港永久居民嘅雙非人士,不會獲得香港國籍以及居留身份,佢地嘅父母永久不得入境香港。呢班友,根本係中國殖民香港嘅棋子,賊嚟。
b. 喺香港定居多年嘅少數族裔,可以得到香港公民身份,以及保障佢地永久居留權
c. 好似溫雲超、毛向輝呢啲以專才計劃得到香港身份證嘅敵視香港嘅中國人,一旦獨立一定唔俾進入香港,唔好講其他嘢。都係果句,呢啲友係賊嚟。

  1. 如果香港真的獨立的話,會否在國籍法內給予香港BNO人士選擇做香港人,或中國人,或兩者也不選擇,做無國籍人再自動轉BC?

    當然從獨立後衍生出來的國籍問題是複雜的,例如福利問題。但本人認為要給香港人自由選擇。如果有人放棄中國和香港籍,去拿BC,他們也要明白放棄國籍後的得失責任,及效忠英國。

    We may need to leverage the holders of whom holding both BN(O) and HKSAR passports currently and having Permanent Residency in Hong Kong within 20 years. They are likely the most trustworth group of people who can involve in development of FUTURE Hong Kong since their diversity, cultural background and as less connections with Mainland China as possible from risk of being Moles or moved by overwhelmed and improper sympathy towards Mainland China or Taiwan.

    Because China forcefully imposed “Chinese” nationality on Hong Kong BNO People after 1997. They should have a right to choose their nationality freely after independence. If not, even Hong Kong one day become independence, it will be no difference as the communist regime.

    Like Bobo case, we could see how he suffered.

    In extreme situation, if many HK people choose to give up either HK and Chinese Nationalities, and claim BC But STILL wanted to live and work in HK. Well, the NEW HK government should setup a special permit for them, but they will not eligible to have some sort of rights, like applying any social welfares from Hong Kong.

    I think the permit arrangement will also help to avoid the great influx of the immigration problems for the UK government too, as Hong Kong people have to think very thoughtfully about their nationality. If you claimed BC, you’ll lost some of the HK citizen’s rights, that’s opportunity cost.

  4. Allan Zeman of LKF and Ocean Park fame is probably another good example of Chinese chauvinism. To this day, his application for a HKSAR passport has yet to be ratified, goes to show the Chinese Communist Party doesn’t give a shit about you licking their boots if you’re not “Chinese blood”.

    The mutually exclusive approach towards Mainland China and Taiwan can keep Hong Kong from influence initated by them. However, the mutually exclusive approach towards BN(O) possible lawful change into BC and other current bearing of Commonwealth citizenships like Canada, New Zealand and Australia may cause Hong Kong suffer from diplomatic isolation, loss of possible leverage with Commonwealth and immediate loss of large amount of skilled and well-educated labours from migration overseas.

    No dual-nationality policy may cause Hong Kong fall into another Singapore and ignored the reality of last 3 decades Hong Kong connections with overseas immigrants and their dual nationalities. This gap likely causing key positions taken by the new Double-Non children. Such damage would larger than tolerating the majority of dual nationality of BN(O) and HKSAR currently changing into BC and Hong Kong dual nationality while UK can pay for its debt owe Hong Kong people since British Nationality Act 1981.

    UK likely thanks for your recommendation of no dual-natioality policy which can ease her panic from BN(O) while many current BN(O) holders have no choice but give up BN(O) or future BC for carry out daily livings in Hong Kong.

    Dual Nationality of future BC and Hong Kong from BN(O) historical reason does not attempt to glorify Colonial Era of Hong Kong but a soft-landing exit solution to win Hong Kong peoples’ hearts and minds that they need not to panic to make another uncertain and painful choice of nationality which possibile causing another identity crisis among general public.

    The main problem of the Hong Kong People is, they were lack of chance and self-determination to their nationality, the chance of choosing our nationality should be giving back to us, as we weren’t have any libility to give up our choice in order to serve the politics, i.e. because Hong Kong needs people to stay after independence, for the future prospect of Hong Kong, so we are forced to maintain the Hong Kong citizenships, that is not right.

    Martin Oei stated the minority groups has such problem, some like BoBo would like to stay in Hong Kong, by the other people wants “emergency exits” by having BC passports for securing themselves. They were all suffered from the Hong Kong Government under Beijing. My opinion is: that isn’t a problem exclusively to the minority groups, ethnic Chinese with BN(O) also suffered from that. If there are laws given to those minorities after the independence, the BN(O) holders should be treated the same.

    Martin Oei mentioned before, he will give up BC in ordered to have Hong Kong citizenship if HK become independence, although I am not suggest him to do so.

    I heavily emphasis about responsibilities if they give up Chinese and Hong Kong citizenships, in order to claim BC. It is a purely but serious personal decision if they have to make. Let say for example, a BN(O) man married a mainland woman and they have children born after 1997, that BN(O) man of course he has the right to choose his desired nationality after independence, including BC, but will he give up his family to claim BC, that his wife and children couldn’t? (I supposed the UK government will run a strict law on Hong Kong people in order to limit the influx of immigrants.)

    Just my personal opinion on BoBo case, although he wanted his wife to have a HKSAR passport, and Hong Kong people has a strong desired to want him stay, it wasn’t just an immigration issues, it is also a racial discrimination issue as well (although they said this is not related). It is not right for us to make strong opinions to force somebody stay, because that is selfish. He has children and their generation may suffered more similar discrimination (e.g. Education, or Job prospect, Bobo stated that he couldn’t advance his job because of his race and language problem.) Bobo has to think about it, not just for him and his wife, but his next generations. Personally I rather he use the privilege to leave Hong Kong.

    後話:如果香港獨立後奉英王為名義元首,當時新政府容許雙重國籍,我個人考慮獨立後保留英籍。

    Comment: dual nationality for Commonwealth and (future) Hong Kong citizenships preserve psychological stability among Hong Kong society. Singapore does not allow dual nationality and strcit legal control make Hong Kong new generation understand we cannot totally follow Singapore’s old road and Commonwealth bounding can help future Hong Kong international positioning like Canada, New Zealand and Australia.

    Thsoe 3 above mentioned enjoy propular and friendly international reputation while keeping relatively small size and effective defence capabilities. Singapore spends 5% GDP for Annual Defence Budget which Hong Kong society cannot afford. Soft and Smart Power through leveraging the historical and cultural bonding with Commonwealth members can prevent from accusation of unrealistic affection on United Kingdom and restoring its colonial occupation in Hong Kong.

    I can say yes to your suggestion, but first the British government has to abolish BN(O) and recognise BN(O) holders are BC.

  9. Allan Zeman is already a PRC national.

    Imho HK should rejoin the Commonwealth at once upon leaving the People’s Republic. Dual or multiple should be allowed for citizens of Commonwealth countries and a small number of countries with particularly close ties with HK, e.g., Nepal, Ireland. People who choose to become nationals of the PRC should be required to reside in HK for another seven years, after the separation, to become permanent residents of HK.

  10. 香港警察近年濫用胡椒噴霧的情況日益嚴重,或者應該立例禁止警察向和平示威者施放胡椒噴霧。而且,按照現行香港法例,胡椒噴霧等同武器,濫用者應作蓄意傷人論。如果目前能有辦法做到這點的,最好。不然,日後也應立例禁止。
